Photovoltaic panels are subject to national regulations governing Waste Electrical and Electronic Equipment (WEEE). D. Lgs. 49-2014 : These regulations were introduced to ensure the sustainable management of waste from electrical and electronic devices, with a focus on promoting the recycling and recovery of materials to minimize environmental impact.
The WEEE directive outlines specific responsibilities for producers and distributors of electrical and electronic equipment, including photovoltaic panels, which must be properly managed at the end of their lifecycle. This includes not only the collection and treatment of waste but also providing consumers with clear information about proper disposal methods.
In addition, there are specific provisions in place for the management of this particular category of electrical and electronic equipment:
IV & V CONTO ENERGIA
In relation to historical photovoltaic panels installed in systems benefiting from incentives under the V Conto Energia, as well as those receiving incentives under the IV Conto Energia and connected after June 30, 2012, registration by serial number and warranty is required.
This registration is mandatory, as it forms part of the requirements set by the Gestore dei Servizi Energetici (GSE) for initial access to the incentive and for maintaining ongoing eligibility. It is crucial that systems comply with these obligations to ensure continued eligibility for the financial benefits provided.

COLLEGATO AMBIENTALE
Article 41 of Law No. 221 dated December 28, 2015, which entered into effect on February 2, 2016, introduces a significant obligation for producers of photovoltaic panels placed on the national market. Specifically, the regulation mandates that producers carry out a registration process for all photovoltaic panels, similar to the requirements under the IV & V Conto Energia. This registration must include the assignment of a unique serial number and the provision of a product warranty.
Legislative Decree 118/2020: “End-of-Life” Guarantees for Photovoltaic Panels as an Alternative to GSE Withholdings
Legislative Decree 118/2020 marks a significant regulatory milestone in the management of the “end-of-life” phase for incentivized photovoltaic panels. It systematically addresses environmental sustainability, and the challenges associated with the disposal and recycling of these panels. This regulation reflects the growing emphasis on the circular economy and the responsible management of Waste Electrical and Electronic Equipment (WEEE).
The decree enables accredited Collective Systems to take on the responsibility for the collection, transportation, and treatment of decommissioned panels. Operating under the principle of Extended Producer Responsibility (EPR), these systems play a crucial role in organizing the disposal processes, ensuring that panels are directed toward efficient and environmentally responsible recycling methods. Recycling is particularly important for photovoltaic panels, as they contain valuable materials, such as silicon and rare metals, alongside components that can pose environmental risks if not properly managed.
